Canadian Wheat Board seeks to recoup tariff money
The Canadian Wheat Board would like to recoup money paid under a U.S. tariff on Canadian hard red spring wheat, a spokeswoman says.

A North American Free Trade Agreement panel earlier this month cleared the way for the U.S. government to lift that tariff. North Dakota Wheat Commission marketing director Jim Peterson estimated about $100,000 has been collected. "We think it's important to keep our eyes open and our ear to the ground for any opportunity for our customers in the U.S. who did pay those tariffs to have them recouped," Canadian Wheat Board spokeswoman Maureen Fitzhenry said. "There doesn't seem to be any opportunity at the moment. But if there is an avenue for those customers to get that money back, we would certainly try to help them do that." Peterson doubts there will be an avenue.

"These duties and trade laws have been in effect for many years and that's never been a premise," he said. "I would find ... a very slim chance that the court would ever rule that all that money has to be refunded back to whoever paid the duty."

Fitzhenry said the amount collected is relatively small because the duties dried up the flow of Canadian wheat to the United States. She said an international trade court ruling in a separate case involving refunds on Canadian softwood lumber tariffs might eventually provide a basis for getting spring wheat tariff money returned.
